1. Introduction
These Terms govern use of the Hiregate software and website (the “Service”) provided by Hiregate, LLC. By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
Hiregate may update these Terms to reflect changes in law, the Service, or the user experience. Notice may be provided by email, within the Service, or by updating this page. Continued use after changes become effective means you accept the revised Terms.
If you use the Service for an employer or other entity, you represent that you have authority to bind that entity. These Terms do not replace a separate written agreement between that entity and Hiregate.
2. Service description
Hiregate is an online recruiting operations platform that helps authorized users organize candidate and requisition information, manage pipelines, schedule interviews, communicate, take notes, and follow recruiting activity and outcomes.
The Service may include configurable fields, forms, workflows, reports, role-based access, integrations, importing, search, analytics, and other features designed to support a team’s recruiting process.
Hiregate uses administrative, technical, and organizational measures intended to protect information and may provide onboarding, training, consultation, and customer support services.
3. Use of the Service
You may use the Service only for lawful purposes and in accordance with these Terms. You are responsible for the equipment, connectivity, accounts, and third-party services required to access it.
- Do not violate applicable law or regulation
- Do not exploit or harm minors
- Do not transmit spam, unauthorized advertising, malware, or harmful code
- Do not impersonate Hiregate, another user, or another person or entity
- Do not disrupt the Service, bypass access controls, or restrict another person’s use
- Do not use candidate information unless you have the legal right and necessary consent to collect, process, and store it
4. Your data and responsibilities
You represent that information provided to the Service does not violate privacy, publicity, copyright, contract, or other rights. You are responsible for complying with applicable privacy and employment laws and for obtaining required notices, disclosures, and consents.
Hiregate may limit or terminate access when it becomes aware of unlawful use or a material violation of these Terms.
5. Disclaimers and limitation of liability
The Service is provided on an “as is” and “as available” basis. Hiregate does not warrant that the Service will always be uninterrupted, error-free, or free from harmful components.
To the fullest extent permitted by law, Hiregate and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or revenue; loss of data, use, goodwill, or other intangible loss; unauthorized server access; third-party transmissions; or errors or omissions arising from use of the Service.
If Hiregate is found liable, its aggregate liability will not exceed the amount paid by the user for access to the Service during the applicable period, except where a different limit is required by law. You agree to indemnify Hiregate and its affiliates against third-party claims arising from your use of the Service, violation of these Terms, or violation of another person’s rights.
6. Termination and changes to the Service
Hiregate may limit or terminate access for a violation of these Terms, applicable law, or conduct harmful to Hiregate or other users. Hiregate may modify or discontinue parts of the Service with or without notice.
Where a separate customer contract includes renewal or termination requirements, those contract terms control. Unless a separate agreement states otherwise, written notice of termination must be provided at least 60 days before the end of a contract term to avoid renewal.
7. Governing law and dispute resolution
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Disputes may be referred to binding arbitration under the JAMS Comprehensive Arbitration Rules and Procedures before a single arbitrator in the United States, to the extent enforceable under applicable law.
An arbitrator may grant remedies available in court. The arbitration award will be final and binding, subject to rights and limitations provided by law.
8. General terms
These Terms constitute the agreement governing general use of the Service unless a separate written agreement applies. If a provision is invalid or unenforceable, the remaining provisions remain in effect.
You may not assign rights or obligations under these Terms without prior written consent from Hiregate. Hiregate may assign its rights or obligations. These Terms bind and benefit the parties and their permitted successors and assigns.
