Introduction 1.1 These terms and conditions ("Terms") govern your use of the HireGate software and website (the "Service") provided by HireGate, LLC. 3.1 You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

In any way that violates any applicable federal, state, local, or international law or regulation. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise. To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation. To impersonate or attempt to impersonate HireGate, a HireGate employee, another user, or any other person or entity. To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by HireGate, may harm HireGate or users of the Service or expose them to liability. 3.2 You are responsible for obtaining access to the Service, which may involve third-party fees (such as internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service.

3.3 By using the Service, you represent and warrant that you have legal rights to the candidate information you provide and that it does not infringe on the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. HireGate is compliant with all relevant data protection laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

Limitation of Liability

6.1 In no event will HireGate, its affiliates, or their respective officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses, resulting from (i) your access to or use of the Service, (ii) any errors or inaccuracies in the information provided by the Service, (iii) any unauthorized access or use
